Hi,
I am a dependent of my parents who are currently staying in the U.S. with E-2 Visa. We have stayed in the U.S. for almost 9 years now and we are trying to get a Green Card.
My parents have already filed and received an approved I-140, but my parents say that we have to wait couple years before being able to file I-485.
I don't quite understand why there is a delay between receiving an approved I-140 and filing I-485.
It seems like everybody either files both I-140 and I-485 concurrently or file I-485 immediately after I-140 is approved.
So, my question is: Is there usually a span of time that applicants must wait before filing I-485 after getting their I-140 approved?

Hi guys,
Some of may think "Wait for the actual letter to come" but I feel too nervous and just want to share my thoughts. I applied for EB5 and my I526 was approved. Then I applied adjustment of status and got an I485 RFE. Have not got the letter yet but got the email that my case is on hold right now. Can you tell me about the RFE? Is that common? Is that the first step of denial? I'm so nervous right now. I will write what they are asking when I got the letter which I'm expecting on Tuesday or Wednesday. Thank you very much.
These days people are figiting wrong ful denials through MTRs. RFEs are common and one does not have to worry about RFE. Just wait for your letter and respond accordingly. There is no "first step" for denial - if your case is approvable it gets approved - if not it gets denied - period.

Sounds correct - for labor sub, you need qualification as of labor filing.

My Father is applying for Citizenship in Nov 10. If he becomes Citizen then can I file I485 under F3(married sons and daughters of citizen parents). Category and port priority date of May 03 from my employment base I-485 to I-485 under F3?

after 4 years when they get a citizenship, if they file I-130 (familybased GC) for me and my family and I will be still is US on H1B, can I directly file for adjustment of status or I need to wait till my date will be current?

These are so screwed up...
Looks like they are heavily back logged.. (mabye cause the conslate did not accept PIO and OCI applications for almost a month)
I sent in my daughter's OCI for miscelaneous service - move OCI sticker to new passport...
sent it in March and its still not yet reached the consulate..
when I applied the rules said they need a copy of old passport, they later changed the rules and are now saying you need to send orignal passport.
I sent the orignal passport also to them and since then no update -:(
Just impossible to reach them also...am on the phone since the last 2 hours -:( and still waiting...
they do not reply to emails either.
any one else here having trouble with them ?

You can re-use priority date established on first I-140 for any sub-sequent I-140 filling. As I understand from your post, you have EB3 labor approved and have just filed for I-140 based on it.
Now, parent company wants to transfer you. Generally I would think you should be able to transfer and still have your GC process going if the company indeed is a 'parent company' but seems there is something different here.
As a general rule, as long as your previously approved I-140 remained approved, you can re-use priority date established for that I-140 for any subsequent I-140 petition. The sub-sequent petition can be with any employer, and yes, you would need a new labor to file that new I-140 :)
Try EB1 or EB2 this time :cool:

On July 29 , 2005 you got it approved. What will be EAD 2 's start date? 30 July , 2005 or Jan10, 2006?
If 30 July 2005, then basically you loose 6 months of time, that means you are getting EAD of 6 months duration.

I’m confused about using the EAD. Someone please clarify me….
I already received the EAD for me and my wife. Currently, I’m in the H1b which is expiring on Sep 2008 (6 years are over). My questions are?
•Can I be in H1b and still work another job as a part-time?
------ if the part time job is using a part time H1 only then you will be H1 and dependents in H4 using EAD meaning you lose H1/4
•If my wife wants to work using her EAD does it have any effect on her h4 status?
--- her status becomes AOS pending and H4 is gone
•If my wife loose her job during the use of her EAD what will be her status?

Yes for H1B you are entitled to get Return ticket back to your home country if you are being laid off or fired. Last year my earlier employer offer me return ticket to home contry. They specified that we are offering as per the clause or law of H1B visa. Offcourse I didnt accept it but you cant get money for not accepting this return ticket offer.

My current reporting structure with my employer is:
Client -> Prime Vendor -> Consultant X -> My employer
Another consultant is ready to transfer my visa and the reporting structure there is
Client -> Prime Vendor -> My employer
A prime vendor (not the same client) is also ready to transfer my visa
Client -> My employer
I am planning to transfer it to either (or both) of the above two companies. Will there be a problem in those two companies filing for a tranfer at (approx) the same time?
Is there a way I can ask an attorney directly (I am willing to pay for that service)

I beleive you need to choose Indian Citizen residing in United States .Check on thrusdays and fridays more closely
