I don't know about legal risks but health-wise that sounds quite risky.

If every one thinks like you, how in the world would drugs be developed to cure the diseases? :D :) Note that before any drugs gets to the stage of human subjects research, it would have completed several trials to ensure that its safe. Adverse events may happen during the trial but in recent studies, not many.
Generally, there will be an orientation and screening before enrollments, you will get all the information at that stage and you may choose not to enroll or if you have any particular condition identified during screening, you will not even be enrolled.
Risks are very minimum. Good luck.

If you have been in the US for more than 1 year, you are a resident of the US and not any particular state in India. You are free to go to any Consulate in India. Even though I was previously a resident of AP, I have been able to get successful stamping in New Delhi.

2 weeks ago i closed 30 year fixed ..I didnt face any issue ..Right now my mortgage held by Fannie. I got a good deal though i am on H1B!

Guys,
I was coming to work and just heard a small advertizment about "All Things Considered" on NPR. The advt said like this -"There is so much debate is going on about illegal immigrants but there is little debate about Legal Immigration, that story later on today on 'All Things Considered'. "
Anyone has any idea? Not sure if they will be taking phone calls or its pre-recorded story but it will be good to have IV feature or at least IV agenda featured on NPR.

1 - Came to US on B2 (visit visa) in October, 1999. My legal stay way valid till April, 2000
2- Found an employer and in March, 2000 filed for H1B/extension of stay. Lawyer at the time told me that since we filed H1 i don't need to file any other extension of stay
3- August, 2000 received approval notice of my H1 but approval notice mentioned start date of October, 2000 rather than March, 2000 as requested in the petition and approval notice did not have the I-94 card attached with it meaning they did not change my status. Appealed the decision and got some feedback from USCIS that they will look into this. Started working for the company in October, 2000. In January, 2001 Company received another notification from USCIS but I was never provided the copy so not sure what was the decision and was told all is fine but never provided the final approval notice. When i checked case status back in January 2001 it said case approved and approval notice sent. However when I check online case status now I see following,
Application Type: I129, PETITION FOR A NONIMMIGRANT WORKER
Current Status: Cable sent to American Consulate or port of entry notifying them of approval.
On September 7, 2001, the appropriate American Consulate or port of entry was notified of the approval of this case. Please contact them directly if you need more information.
4 - In 2002 transferred my H1 to new company and got the approval with new I-94 card without any issues.
5- In 2004 transferred my H1 to another company without any issues and I�m with that company since then. They filed my labor, I-140 which has been approved and now ready to file I-485. Lawyer of this company wants to attach the approval notice of my first H1 from 2000 with I-94 card attached to it showing proof of my change of status which i don't have. I have approval notice without I-94 card from 2000.
6- I also left the country in 2006 and went to Canada for two weeks and then came back in the same month without any issues.
Current lawyer is fling I-485 without my first approval notice from 2000. Do you think this would cause issues or generate RFE for I-485? I heard that once you leave the country and re-enter legally all previous status issues if any are put to rest, I left the country in July 2006 and re-enter in the same month?

A colleague and I both filed EB2 PERM labors at around the same time in 2005.
Our 140s got approved roughly together too/
We both also applied for 485 on July 2nd, through the same lawyer, and both applications went to TSC.
Both of us saw our checks get encashed on the same date.
Here's where our applications diverged.
He received an LUD last friday and his EAD card has been ordered.
I received an FP request today(monday) but no LUD updates.
Although our applications are a bit dis-similar (he is married, i filed single), I have this theory that USCIS is splitting their queue, so as to not bombard its internal departments with the flood of work that has recently come in.
It makes total sense to split people into two groups (atleast), and for each:
a) send them EAD cards with a note of FP pending.
b) send them FP notices and do their EAD later.
(I know another friend who is in group a, while I'm in b)
Yes, we all like to bitch and moan about USCIS, but thats generally emo-talk.
So, has anyone else noticed this, or can anyone help me understand what I'm missing here.

I don't think you read his question- He/She wanted to know if the FP can be done in an American Consulate General in India if he gets his FP notice while he/she is in India.
Does anyone know of this situation and if any consulate in India can do the FP?
If you get your FP notice while in the US go to the ceter any day at 7.45 am before the center opens and request the staff to do the FP.They generaly oblige.I did it in Los Angeles.

Hi Gurus,
I need some advice from you guys
My initial receipt date for I-485 from Vermont service center was July 7th 2007. But when I-485 was transferred to Texas service center, receipt date on I-485 is showing as September 11th 2007. Can we do anything to correct the wrong receipt dates as this might have significant impact on my processing times. Please advice

My only question with your scenario is the how did you think that even without the current scenario of frontlog how can you expect to receive the I-485 receipt in one week.
Based on your timeline your PD will be current in Nov, and you can still file after your return, why take chances.

Another question : when you say back to normal process, what do you mean ?
I found that the "Govt error appeal cases" are processed as current, standard appeal have a backlog of aug 2007. My employer said mine wouldn't fall under any of these two conditions. He is confident that the CO just will certify anytime soon. Is this the case ?

I asked exactly the same question a few days ago and ppl replied that h1B is totally different case. H1B does not get affected irrespective of whethe it came thorugh due to 140 already approved or LC approved or a < 6 years limit.

I am planning to port my EB3 to EB2 but I donot have the Approval copy of my I-140 of my EB3 (But I have the receipt number) and I asked my privious Employer(who applied my case in EB3 and I used AC21 and moved to another company) for a copy of approved I-140 and he is not willing to give it to me.
Can I still port with out having I-140 approval copy of EB3? if yes, how?

Always look at last action taken by the USCIS. If USCIS approved your H-1B for employer D, and attached I-94, that means that as long as you are working for employer D at this time and at the time you extend and re-stamp your H-1b visa, there should be no problem. Make sure you take W-2s and Tax returns from previous years you were in H-1B status when you go for a new Visa Stamp.

I e-filed yesterday and the address came as USCIS Nebraska Service Center, as expected. My 485 is pending there and my previous EAD was also from NSC.
Where was your last EAD and 485 applied and processed at?

You can apply for H1 transfer now.. but you'll more than likely get a RFE for paystubs.. and if you can provide them (and depending on your job, client letter etc.,) you are good.
If you old company cancels your h1, you are still good if you applied for transfer before that...
The only risk might be that you might get approval without I-94 if your old I-94 expired already, which is not true in your case I assume..
Btw, this is a public forum, you can expect responses, but no one is paid or obliged to do so... so URGENT responses should not be expected here... for such cases, you better pay for a lawyer.
