    It's only IV members. We did decide on few things last time, We have some new ideas, to talk. Obviously we need more people to carry on with the efforts...There are several private bills that are being placed in the queue as well as I see a separate bill for foreign nurses is coming up for discussion, we I feel we should talk to our lawmakers to bail us out of the EB-3/EB-2 India/china messWho other than IV is expected or invited in this call? Do we have any agenda, or just a brain storming?

    Thanks for your reply. By B1 Visa, I meant that I will go to client side and understand the project and meanwhile my employer will file my H1 Transfer. and on B1 I wont get paid.

    I have seen the giuys who come on B1 from their Indian Offices for 1-2 month period.

    Suggestions are really appreciated since client is not agreeing to extend the joining date and that the only criticality I have in my situation.

    Any Experience is highly appreciated.

    Not all non-profits are cap-exempt.

    He could theoretically apply for a change of status from B-2 to H-1B. However he should not be using the B-2 to look for work. Any change of status, or H-1B visa application at a consulate, might bring up the questions of his activities in B-2 status, and whether he misrepresented anything. If he found a job while in the US in B-2 status, his activities in B-2 status might be questioned.

    Sorry to hear about your upcoming hardship..
    I 've had a similar situation recently - where my H1B (with employer A) was about to expire and then another employer (B) had to recruit me, they filed for transfer+extension.
    In I129 while filing, they would have to select (cant recall the exact verbiage) new employer (related to transfer) AND extension of current status. Its better to file this kind of petition premium. I got the new approved petition within 2 weeks with new expiry date as +2yrs, with start date earlier than the H1B expiry date (with A).

    I got my FP done a couple of weeks ago at the Dallas ASC on the scheduled date. Have noticed from other threads that people have gone to other ASC at an unscheduled date and were able to get it done. I think you can go as well and explain your situation if they object. If they are not too busy that day they might let you in; guess the hours are from 8AM to 3PM. You can try to be the first one in the morning. It doesn't take more than 15 minutes for the entire process. Good Luck!!

    Do you know your I-485 receipt number? If yes, then request FOIA to get all the documents attached to your I-485 case number, then they will send you all the documents in your I-485 case file and I-140 document will be there in it. You might also need to enter your A# in FOIA request.


    If you dont know your I-485 receipt number then I am not sure how to send FOIA request.

    I received a copy of I 485 Receipt Notice from my lawyer today. The priority date is empty in the receipt notice. Is this normal?

    Hi
    My 140 got approved and 485 is in pending state.I have my EAD and also valid H1.

    1.Can I add my spouse to my GC status when PD is not current?My spouse is on H1B visa.

    2.If I start using EAD, is it still possible to add spouse or I should maintain valid H1 status?

    Can you please respond back ASAP.Thanks.

    Your spouse can file I-485 only when your PD is current. Until (s)he needs to maintain H1/H4 status.

    I agree. For example, in Germany, it is hard to work if you do not speak German. Also in France and all others.

    And even in Scotland, they speak different English there and you need to be there for many months before you get used to it.

    dear h1bs.
    the only reason i'm staying here is to complete the 10 years of social security payments. leaving now would be foolish. this green card business is just a carrot to get endlessly humiliated.

    does anyone have any knowledge of non-citizens claiming social security in india?

    as per the SS, indian citizens who have contributed >= 10 years can claim SS payments in india.
